Will New York’s minimum wage go up in 2027?

How the tip credit works in New York

Employers in New York can pay tipped workers $11.35 an hour as long as your wages plus tips for the workweek come to at least $17.00 for every hour worked. If they don’t, the employer has to pay the difference.

For example, 30 hours at $11.35 comes to $340.50. With $100.00 in tips, you’d have $440.50. The minimum for 30 hours is $510.00, so your employer owes you $69.50.

Good to know

Varies by region; this page uses the rate for NYC, Long Island and Westchester. Rest of the state: $16.00 (tipped cash wage $10.70). The tipped cash wage is the one for food service workers. It won’t go up on January 1, 2027: the state froze the increase because employment fell; a proposal for $17.60 / $16.55 from March 1, 2027 still needs the Legislature.

Overtime

Under federal law, hours over 40 in a workweek are paid at time and a half (1.5 times your regular rate): at New York’s minimum, at least $25.50 an hour. New York has no daily overtime: a 12-hour double only gets you overtime if it takes your week past 40 hours.

With a tip credit, your employer still has to pay you at least $19.85 in cash wages for each overtime hour: $25.50 minus the $5.65 tip credit. How overtime works with tips.

PayJar applies weekly overtime from the start and lets you turn on daily overtime and double time. Add up your week’s hours and overtime in the time card calculator.
