How hours and overtime are figured
Each day: the end time minus the start time, minus your unpaid break. A shift that runs past midnight counts for the day it started.
Overtime starts past 40 hours in the workweek, at 1.5 times your rate. California also pays it past 8 hours in a day, and double time past 12; Alaska, past 8 hours; Colorado, past 12. Hours already paid as daily overtime don’t count toward the 40, so no hour is paid extra twice.
The example week has 45 hours. Under the federal rule, 5 of them are overtime, and at $17.00 an hour the week pays $807.50. In California, Friday and Saturday pass 8 hours, so the same week has 6 hours of overtime and pays $816.00.
On a tipped wage, overtime is figured on the full minimum, not on the tipped wage: $7.25 × 1.5 = $10.88, less the $5.12 tip credit, is $5.76 an hour under federal law.
